{"id":1540,"date":"2016-12-22T12:21:15","date_gmt":"2016-12-22T06:51:15","guid":{"rendered":"http:\/\/www.infipark.com\/articles\/?p=1540"},"modified":"2023-08-08T14:13:55","modified_gmt":"2023-08-08T08:43:55","slug":"battery","status":"publish","type":"post","link":"https:\/\/www.infipark.com\/articles\/battery\/","title":{"rendered":"Battery"},"content":{"rendered":"\n<p>A Battery is the application of force , to the person of another , intentionally , without lawful justification ,in however slightest manner the force may be applied .It is striking of another\u2019s person hostilely , or against his will , in angry , rude , revengeful and insolvent manner .<\/p>\n\n\n\n<p>As for examples , kissing a girl , removing one\u2019s hat from his head , cutting of one\u2019s hair without her consent sitting on the next bench in college , spitting on one\u2019s face , snatching of a paper from one\u2019s hand are all the wrongs of battery .Similarly , firing a gun carelessly and injuring another is also the wrong of battery .<\/p>\n\n\n\n<p><b>Following are the essential ingredients of battery :-<\/b><\/p>\n\n\n\n<p>i) There must be use of force by the wrongdoer to the victim\u2019s body either directly or through any object .<\/p>\n\n\n\n<p>ii) The force must be used intentionally .<\/p>\n\n\n\n<p>In the famous case of&nbsp;<b>Hurst Vs. Picture Theatre Ltd.<\/b>&nbsp;, the plaintiff purchased a ticket for a seat at a cinema show . However , he was forcibly turned out of his seat under the directions of the theatre manager who was under the mistaken belief that the plaintiff had not paid for the seat .
