Blackstone defined a nuisance as something that \u201c worketh hurt , inconvenience or damages .\u201d The term nuisance has been derived from the French word \u2018nuire\u2019 and the Latin word \u2018nocere\u2019 which mean \u2018 to do hurt or to annoy \u2018. Nuisance has been defined to be anything done to the hurt or annoyance of the lands , tenements or hereditament of another and which is not a trespass .<\/span><\/p>\n\n\n\n

Nuisances are of two types —
i) Public Nuisance and
ii) Private Nuisance .<\/p>\n\n\n\n

The distinction between public nuisance and private nuisance may be expressed better in the following tabular form .<\/p>\n\n\n\n

1.<\/span><\/td>\nWith respect to the public nuisance , if the plaintiff does not sustain special damage , an action for damages is not maintainable .<\/span><\/td>\nBut in case of private nuisance , an action for damages is maintainable .<\/span><\/td>\n<\/tr>\n
2.<\/span><\/td>\nIn case of public nuisance , an action lies for declaration with a prayer for injunction .<\/span><\/td>\nBut in case of private nuisance , an action for damages lies .<\/span><\/td>\n<\/tr>\n
3.<\/span><\/td>\nOne person individually can not sue in his own name for a public nuisance .<\/span><\/td>\nPrivate nuisance is actionable only by an individual .<\/span><\/td>\n<\/tr>\n
4.<\/span><\/td>\nPublic nuisance can not be legalized by any length of time .<\/span><\/td>\nBut a right to create or continue a private nuisance can by acquired by way of prescription .<\/span><\/td>\n<\/tr>\n
5.<\/span><\/td>\nPublic nuisance affects the right , safety or convenience of the public at large or a considerable portion of the public .<\/span><\/td>\nOn the other hand , private nuisance affects right of an individual or a determinate body of persons .<\/span><\/td>\n<\/tr>\n
6.<\/span><\/td>\nA public nuisance can not be abated by any person affected thereby.<\/span><\/td>\nOn the other hand , a private nuisance can be so abated .<\/span><\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<\/div>\n","protected":false},"excerpt":{"rendered":"
