Importantly, <strong>partition between widows does not destroy survivorship rights<\/strong> to properties allotted to each other. <a href=\"https:\/\/www.nujs.edu\/wp-content\/uploads\/2023\/07\/9.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">nujs+1<\/a><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Alienees and Purchasers<\/h2>\n\n\n\n<p><strong>Alienees of coparcener&#8217;s interest<\/strong>, where alienation is valid, have the right to partition. The <strong>Supreme Court in Smt. Kailashpati Devi vs. Smt. Bhuvaneshwari Devi<\/strong> held that purchasers of joint-family property may file general partition suits against joint family members. <a href=\"https:\/\/edumound.com\/study-material\/law\/persons-entitled-to-demand-partition-in-hindu-joint-family\/\" target=\"_blank\" rel=\"noreferrer noopener\">edumound+1<\/a><\/p>\n\n\n\n<p>The <strong>execution-purchaser<\/strong> of a member&#8217;s interest in Bombay and Madras is entitled to demand partition in the rights of that member. However, such purchasers <strong>do not acquire right to joint possession<\/strong> &#8211; their proper remedy is partition. <a href=\"https:\/\/lawbhoomi.com\/alienation-of-coparcenary-property-in-hindus\/\" target=\"_blank\" rel=\"noreferrer noopener\">lawbhoomi+4<\/a><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Adopted Sons<\/h2>\n\n\n\n<p><strong>Adopted sons are treated as natural-born sons<\/strong> and entitled to demand partition anytime after adoption. Partition by Mere Declaration to Separate<\/h2>\n\n\n\n<p>Partition under Mitakshara is <strong>a matter of individual volition<\/strong>. All that is necessary is a <strong>&#8220;definite and unequivocal indication of intention&#8221;<\/strong> by a joint-family member to separate and enjoy his share in severalty. <strong>Filing a partition suit is a clear expression of such intention<\/strong>. <a href=\"https:\/\/lawbhoomi.com\/reopening-and-reunion-of-partition-under-hindu-law\/\" target=\"_blank\" rel=\"noreferrer noopener\">lawbhoomi+3<\/a><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">2. Partition by Notice<\/h2>\n\n\n\n<p>Severance may be effected by <strong>serving notice<\/strong> on other coparceners, indicating intention to separate and enjoy property in severalty or demanding partition. The notice may be <strong>subsequently withdrawn<\/strong> with consent of other coparceners, preventing partition. <a href=\"https:\/\/blog.ipleaders.in\/hindu-law-of-partition\/\" target=\"_blank\" rel=\"noreferrer noopener\">ipleaders+1<\/a><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">3. Sons in Mother&#8217;s Womb<\/h2>\n\n\n\n<p>A <strong>son conceived at partition time<\/strong>, though not born before partition, <strong>can reopen it<\/strong> if no share was reserved.
