Chapter VIII of the Uttar Pradesh Urban Planning and Development Act, 1973
Section 28‑A – Sealing of Unauthorised Development
Section 28‑A gives the Authority power to seal premises where unauthorised development has been carried out or is being continued, by ordering closure and physically sealing the building or part thereof. Sub‑section (4) provides a statutory appellate remedy against sealing orders, usually to the Chairman of the Development Authority, subject to prescribed conditions.[8][16][3]
Courts have read Section 28‑A in conjunction with Sections 27 and 28, holding that sealing is an adjunct to demolition or stoppage powers and that, as a rule, proceedings under Section 27 or 28 should be initiated before or alongside sealing. The Uttarakhand High Court, for example, set aside conditions in an order under Section 28‑A(4) and reiterated that sealing must be preceded by proper proceedings and cannot be used to bypass the statutory scheme of notice, hearing and compounding where available.[16][8]
